Chain Store Background Music Copyright Compliance Notice
According to the Copyright Law of the People's Republic of China, playing background music in stores for the public constitutes mechanical performance and requires commercial authorization. Playing music without permission is an infringement act.
A song contains dual rights: musical work copyright (lyrics and composition) and phonogram rights. Once evidence is collected and a lawsuit is filed, both the store and the brand headquarters are liable for compensation, and multi-store chain brands will face high compensation risks.
There are two legal authorization channels:
1. Apply for public performance license simultaneously from MCSC and CAVCA;
